These Terms of Service ("Terms") govern your access to and use of the services provided by ORBTL Digital ("we", "our", "us"). By signing up for or using our platform, website, or services, you agree to these Terms.
If you do not agree with these Terms, please do not use our services.
1. Overview of Our Services
ORBTL Digital provides a fully managed, all-in-one digital platform for service-based businesses. This includes a hosted website, CRM, automations, mobile app access, and marketing tools — delivered under a monthly subscription based on usage.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use our services.
3. Account Setup & Information
To access ORBTL services, you must provide accurate and complete information during onboarding. You are responsible for maintaining the confidentiality of your account credentials.
4. Pricing & Billing
All pricing is listed in AUD and includes GST (if applicable).
Plans are usage-based (emails, SMS, users). All features are included in every plan.
Additional usage (top-ups) may incur extra charges, starting at $10.
Plans are billed monthly or annually, with a 10% discount for annual subscriptions.
Payments are processed securely via Stripe.
5. Plan Pausing & Cancellation
You may pause your plan for up to 2 months per calendar year while retaining access to your system and data.

If you cancel within the first 12 months and wish to retain your website, CRM setup, or content, a one-time exit fee of $500 will apply for export and transfer of assets.
6. Data Use & Privacy
Your data is handled in accordance with our Privacy Policy. We collect personal and business data only as required to deliver our services, and we do not sell your data.
7. Acceptable Use
You agree not to use ORBTL Digital:
For unlawful, abusive, or misleading purposes
To send unsolicited messages or spam
To attempt to reverse-engineer or tamper with platform components
We reserve the right to suspend or terminate accounts that violate these conditions.
8. Platform Access & Uptime
We aim to maintain 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance or third-party outages may cause temporary disruptions. We’ll always do our best to minimize interruptions.
9. Support
All plans include access to support via email and quarterly success calls. Response time is typically within 1 business day. Support may include system setup, general troubleshooting, and usage guidance.
10. Ownership of Content & Intellectual Property
All software, templates, automations, and content provided by ORBTL Digital remain the property of ORBTL unless transferred through the exit fee process. You retain ownership of your customer data and uploaded content.
11. Disclaimer of Warranties
We provide the platform "as is" and make no guarantees about uptime, performance, or suitability for any specific business outcome. While we strive to deliver value, results may vary depending on your usage.
12. Limitation of Liability
To the extent permitted by law, ORBTL Digital shall not be liable for indirect, incidental, or consequential damages, including lost revenue or data, resulting from the use or inability to use our services.
13. Changes to These Terms
We may update these Terms periodically. If changes are significant, we will notify users via email or on the platform. Continued use of the service after updates constitutes acceptance.
